Rental terms and conditions
Working draft — the final text must be reviewed by a lawyer before launch.
Fields in square brackets are filled in from the company settings before publication.
This is a translation provided for convenience. The Romanian version is the legally binding one.
1. Parties and subject matter
The rental service is provided by [enter the legal name], with its registered office at [enter the address], tax identification code (CUI) [enter the CUI], Trade Register number [enter the Trade Register no.], under the trade name AVANT SKI (hereinafter “AVANT SKI” or “we”).
The customer is the adult who makes the booking or collects the equipment (hereinafter “the customer” or “you”). The customer is also responsible for the other participants included in the booking, including minors.
The subject of the contract is the rental of ski and snowboard equipment for a fixed period (for example skis, ski boots, poles, snowboards, snowboard boots, helmets), individually or in packages. By confirming the booking or by collecting the equipment, you accept these terms.
2. Booking and confirmation
You can book online, without an account, or at the rental desk. For each participant you enter the activity, height, weight, shoe size and skill level, and for children also their age. You are responsible for the accuracy of this information; it is the basis for choosing the equipment.
Online bookings can be made at least 2 hours before pick-up and no more than 180 days in advance, for up to 6 days and 12 people.
Availability is checked in real time. Your booking is confirmed when you receive the confirmation email with the booking number and QR code.
The sizes suggested online are a guide and are confirmed at pick-up, subject to the equipment available. We may replace an item with an equivalent or better one if the suggested item is not suitable or not available.
3. Prices and payment
Prices are those in the price list published on the Prices page, valid on the date of pick-up. The total price of the booking is shown to you before you confirm it. Prices include 21% VAT.
- Every calendar day started is charged. If you return within one hour after midnight, no new day is counted.
Available payment methods:
- Pay at pick-up, at the desk.
At the rental desk you can pay [enter: cash, card, other methods]. An invoice or fiscal receipt is issued in accordance with the legislation in force.
4. Changes and cancellation
You can request a change or cancellation of your booking on the My booking page, using the personal link in the confirmation email. Changes (rental period, times, participants, sizes) are subject to availability and are confirmed by us by email; the price is recalculated according to the applicable rates.
Cancellation terms: [enter the deadline for free cancellation and any amounts retained after that deadline].
Failure to show up for pick-up without cancelling first: [enter after how long the booking is treated as not collected and what happens to the amounts paid].
Under Article 16(l) of OUG no. 34/2014 (the Romanian Government Emergency Ordinance on consumer rights), the 14-day right of withdrawal does not apply to services related to leisure activities where the contract provides for a specific date or period of performance. An online booking for a specific period falls into this category; cancellation follows the rules above.
5. Picking up the equipment
At pick-up, the adult customer:
- shows the booking QR code or the booking number;
- shows a valid identity document, which is photographed at the rental desk; the photo is stored encrypted and deleted 14 days after the rental ends, unless a damage claim is pending (details in the Privacy policy);
- signs, on the tablet, the agreement on the processing of personal data and the declaration accepting the risks of skiing and snowboarding, on their own behalf and on behalf of the participants they represent;
- pays the remaining balance and, where applicable, the deposit.
We cannot hand over the equipment without these steps.
6. Checking and adjusting the equipment
Before handover we check the equipment together. Our staff adjust the bindings (including the release value, or DIN setting, on skis) according to the participant’s weight, height, skill level and ski boots. You must declare this information correctly and try on the ski boots or snowboard boots before leaving.
If you notice a problem at handover, tell us straight away. By taking the equipment you confirm that it is in good working order, except for any remarks that have been recorded.
Do not change the binding settings yourself. If you need a new adjustment or a different size, come to the rental desk during opening hours.
7. Using the equipment
- The equipment may only be used by the participant it was chosen and adjusted for; it may not be sublet or lent to anyone.
- It is to be used on prepared slopes, in accordance with the rules of the ski area and of the mountain rescue service (Salvamont).
- Use off-piste, on areas without enough snow, on rocks, on asphalt or in unsuitable conditions is the customer’s responsibility.
- Look after the equipment when you are not using it and do not leave it unattended.
- If the equipment breaks, stop somewhere safe, stop using it and bring it to the rental desk.
- We recommend that all participants wear a helmet, especially children.
8. Returns and late returns
The equipment must be returned to the rental desk, reasonably cleared of snow, by the date and time set in the booking.
- You have a grace period of one hour after the agreed return time.
- After the grace period, we recalculate the price for the actual rental time at the same rates, and you only pay the difference.
- Because calendar days are charged, a delay of a few hours on the same day usually doesn't change the price; returning the next day adds at least one day.
Returning the equipment early does not entitle you to a refund of the price difference, unless we agree otherwise.
9. Damage, loss and theft
When the equipment is returned we check its condition. Normal wear and tear is not charged. The customer is liable for damage caused by improper use, negligence or breach of these terms, as well as for loss or theft of the equipment.
- Repairable damage is charged at the cost of the repair: [enter the repair price list or how the cost is calculated].
- For equipment that is lost, stolen or beyond repair, the replacement value is charged: [enter how it is determined, e.g. the value in the list displayed at the rental desk].
- Theft must be reported immediately to the authorities and to us, with proof that it was reported.
Damage is assessed in the customer’s presence whenever possible and recorded on the rental record.
10. Deposit
For the rental of any equipment, a deposit is required at pick-up. The deposit amounts are as follows:
- Full ski set: RON 500.00
- Skis: RON 300.00
- Ski boots: RON 250.00
- Poles: RON 50.00
- Helmet: RON 150.00
The deposit is refunded in full when the equipment is returned in proper condition. Amounts owed for late return, damage or missing items found at return may be deducted from the deposit, with an explanation of each amount.
11. Minors
Equipment for minors can only be booked and collected by an adult (a parent, guardian or person to whom the minor has been entrusted), who signs the documents on the minor’s behalf and is responsible for the use and return of the minor’s equipment. The adult makes sure that the minor is properly supervised and wears a helmet.
12. Liability
Skiing and snowboarding involve inherent risks of injury, which the customer accepts. AVANT SKI is responsible for handing over equipment in good working order and for the adjustment carried out by its staff, based on the information declared by the customer.
We are not liable for accidents or damage caused by the conduct of the user or of third parties, by failure to follow the rules of the slopes, by incorrectly declared information, by the customer changing the settings or by use of the equipment in unsuitable conditions. These limitations do not apply in the case of intentional misconduct or gross negligence by AVANT SKI, nor where the law does not allow liability to be limited.
We recommend winter sports insurance that covers accidents, rescue and third-party liability.
13. Complaints
Complaints can be made at the rental desk or in writing, to contact@avantski.ro or +40 750 466 009. Please mention your booking number. We reply within [enter the time limit, e.g. 30 days].
14. Applicable law and dispute resolution
The contract is governed by Romanian law. Disputes are settled amicably or, if that is not possible, by the competent courts in Romania.
Consumers can contact the Romanian consumer protection authority, the National Authority for Consumer Protection (ANPC), at anpc.ro, including for the alternative dispute resolution (ADR) procedure. The European online dispute resolution (ODR) platform, ec.europa.eu/consumers/odr, stopped accepting complaints as of 20 July 2025, under Regulation (EU) 2024/3228. [check whether the reference to the ODR platform is still needed]
15. Final provisions
We may update these terms. The version that applies to a booking is the one accepted when the booking was confirmed. If any provision is held to be invalid, the others remain in force. The processing of personal data is described in the Privacy and cookie policy.
